Tradie Law will give you all the tools to follow a fair and reasonable process when undertaking a business restructuring and reaching a decision that withstands scrutiny if an employee challenges a redundancy by way of termination.

What's Included in Our Restructuring Legal Package?

1) Initial consultation and discussion (1-2 hours):
The restructuring process can be complicated. We want to talk to you regarding the issues your business is facing and gain an understanding of why you are considering a restructure. We will review your employees’ employment agreements and map out the structural changes that may arise if you proceed with a restructuring.  

2) Letter explaining the restructuring process: 
All restructurings must be carried out in fair and reasonable manner (consultation). We summarize what a fair and reasonable process looks like and the dos and don’ts you should be aware of to lessen the risk of a claim being made against you or your business.  

3) Memorandum/Letter to your employee’s setting out the restructuring proposal: 
We provide you with a draft example of a restructuring proposal that sets out the basis of the restructuring proposal, a time frame for consultation and feedback and what may happen if the proposal is implemented. 

4) Guidelines on how to conduct consultation/Feedback meeting:
These meetings can throw up curve balls. We will provide you with a set of basic rules to ensure the meetings stay on track. 

5) Decision on Proposal and Notice to employee’s if proposal is implemented: 
The final decision is very important in terms of summarizing the proposal, feedback and your consideration in reaching a final decision. It should also cover off notice requirements and entitlements if the proposal is implemented and redundancies arise. We will provide you with a template which covers all relevant considerations. 

6) Follow-Up Support (1-2 hours): 
We understand that questions and concerns will arise during this process. That's why our team of expert legal professionals provides you with up to 2 hours of follow-up support after the initial review to address any queries as the process proceeds and to ensure your peace of mind.

Pricing

Our Restructuring Package is available at a total cost of $3,500.00 (plus GST and Disbursements) with the option to pay in two installments.
